Pennsylvania State Law regarding dogs:​

 

We love our pets here in Evergreen Farms and love seeing our furry friends with their owners in the neighborhood. To protect all of our neighbors, please be aware of Pennsylvania's laws regarding dogs.

Under Pennsylvania’s Dog Law (3 P.S. § 459-305), as well as The Township of Fairview Animal Control Ordinance of 1977, Chapter 99 - Animals, § 99-3, it is unlawful for an owner to allow their dog to be unrestricted or "run at large". Dogs on the owner's premises must be physically restrained by a leash or under the immediate control of a responsible person.

Additionally, Chapter 99 - Animals, states that, “Continuous barking, howling or the making of other loud noises by such animal for more than any one-hour time period, or continuous barking for periods of less than one hour but more than 1/2 hour, which periods occur on two or more consecutive days or nights, shall be deemed to disturb the peace and to cause the annoyance and discomfort of persons in the Township of Fairview."

Regarding Dog Bites: Dog bites must be reported immediately to the Erie County Department of Health or local police. Medical professionals are legally required to report suspected bites. This initiates a mandatory 10-day rabies quarantine for the dog. We do not wish to see this happen with your pets, which is why we request that they be controlled and contained.

FIREWORKS

We understand that there are holidays throughout the year to celebrate. Per PA Title 72, Section 9404(b)(5), a person may not intentionally ignite or discharge consumer fireworks within 150 feet of an occupied structure.

There is no place in Evergreen Farms - on a street or in a yard - that is more than 150 feet from someone else's home. Therefore, fireworks should not be set off in the neighborhood. If they are and you wish to file a complaint, you may call the Pennsylvania State Police at 814-774-9611.

We have several combat veterans in our neighborhood who do not appreciate unannounced firework shows. If your goal is to celebrate or honor our veterans, past and present, please refrain from using fireworks to do so! Our pets would appreciate that also.

ATTENTION PARENTS:

Please teach your children to watch for cars and to NOT play in the street! Evergreen Farms is a small neighborhood; however, there are still cars driving through and concerns have been raised about children not getting out of the street.

Also be aware that, in Pennsylvania, anyone under the age of 12 must wear a helmet when riding a bicycle. This applies to anyone operating the bicycle, riding as a passenger, or riding in an attached restraining seat or trailer. The Pennsylvania Department of Transportation strongly recommends that all bicyclists wear helmets whenever they ride.

Front Yard Tree

Per Exhibit B: Restrictions, Paragraph 15 of the Evergreen Farms Homeowners Association Bylaws, each Unit Owner shall be responsible for planting one hardwood or flowering tree that is a minimum of two (2") inches in caliper as measured 6 inches from the base of the tree. Said tree must be planted in the front yard. 

Signs

Per Exhibit B: Restrictions, Paragraph 19 of the Evergreen Farms Homeowners Association Bylaws, no billboards, political signs, or advertising signs or devices may be placed on any Unit, within windows, on any house or on other structure within the Planned Community. 

Grass

Per Fairview Township Code: Chapter 139: Brush, Grass and Weeds; § 139-2; paragraph B

  • Permitting or maintaining the growth of any grass, weeds, noxious weeds or any vegetation to the extent that it exceeds six inches in height.

Projects and
Complaints

All home-improvement project requests must be submitted through the official form found on this website in the dropdown menu under your name above. This is necessary for our record keeping in case we are audited.

Residents are encouraged to talk to their neighbors before submitting complaints, but if that does not work and you feel the HOA Board needs to get involved, you must use the complaint form, also found in the dropdown menu under your name above.
